ADVICE IN THE EVENT OF AN ACCIDENT

  • If you are involved in a traffic accident, as a driver, always keep calm.
  • The information about those involved, the vehicles and their insurance companies is recorded in this document. A record is also made of the damage to the vehicles.
  • For the document to be valid, it must be signed by the drivers involved. If they are not in agreement, or if there are injured parties, the Local Police or the Catalan Mossos d’Esquadra (or corresponding police force) must be called so they may write the relevant report. This document will be the main evidence to determine who is at fault.
  • In this case, it would also be very helpful to take down the information of people who have witnessed or who may provide information about the accident.
  • Your insurance company must be informed of the accident within seven days.
  • If you or any of the occupants of the vehicle have suffered personal injuries, keep the medical assistance documents that show the injuries caused by the accident, as well as the receipts for any costs that such injuries have generated, and the reports issued by the doctor, sick leave, X-rays, CAT scans, etc.
  • It is just as important to keep the receipts relating to material damage (vehicle repair invoices or estimates).
  • It may also be useful to take photographs of the damage caused, both to the vehicle and to personal objects.
  • These documents and evidence will be very important when claiming economic compensation for the damage incurred, both material and personal and the resulting consequences.
  • Remember that any victim of an accident, whether it is the driver, occupant of the vehicle or a pedestrian, is entitled to compensation, as long as they have not caused the accident.
  • To claim the corresponding compensation, take any necessary legal action, file complaints, etc., it is a good idea to contact a lawyer who specialises in traffic matters. They will advise you throughout and try to get you the most compensation possible.
